General Terms and Conditions (GTC)

(The following GTC also contain statutory information regarding your rights under the regulations governing distance contracts and electronic commerce.)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all deliveries, services, digital products, and subscription contracts concluded via our online shop between Fa. Werner Larsen and consumers (§ 13 German Civil Code – BGB). A consumer is any natural person who enters into a legal transaction for purposes that predominantly are neither commercial nor their self-employed professional activity.

2. Contractual Partner

The purchase agreement is concluded with:

Fa. Werner Larsen

Wieckhorster Dorfstr. 7

29640 Schneverdingen

Germany

E-Mail: wlarsen@shadangayoga.com

Phone: +49 (0) 5193-52626

You can reach our customer service for questions, claims, and complaints on business days from 9:00 AM to 6:00 PM.

3. Conclusion of Contract and Ordering Process

3.1 The presentation of products, digital content, and subscriptions in the online shop does not constitute a legally binding offer, but an invitation to place an order (online catalog).

3.2 The customer can select products, digital access, or subscriptions and place them in the virtual shopping cart. By proceeding through the online checkout system (SureCart), the customer submits a binding offer to purchase.

3.3 Technical Process & Correction Options:

In the checkout form, the customer enters contact, billing, and shipping details and selects the preferred payment method. Prior to submitting the order, all entries can be corrected directly within the form fields. By clicking the button “Order with obligation to pay” (or a corresponding clearly worded button), the customer submits a binding offer.

3.4 Acceptance of the offer and confirmation of the order receipt take place immediately after submission via an automated confirmation email. The purchase contract is concluded upon receipt of this email confirmation.

4. Right of Withdrawal for Consumers

Instructions on Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period is 30 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods. In the case of contracts for the supply of digital content not delivered on a tangible medium, or for services/subscriptions, the withdrawal period is 30 days from the date of contract conclusion.

To exercise your right of withdrawal, you must inform us:

Fa. Werner Larsen

Wieckhorster Dorfstraße 7

29640 Schneverdingen

Germany

E-Mail: wlarsen@shadangayoga.com

Phone: +49 (0) 5193-52626

Fax: +49 (0) 5193-52627

by means of a clear statement (e.g., a letter sent by post, fax, or email or by means of the withdrawal form on our website) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within 30 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. For contracts involving physical goods, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event no later than 30 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 30 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Special Notice on the Premature Expiration of the Right of Withdrawal for Digital Content

The right of withdrawal expires prematurely in the case of a contract for the supply of digital content not supplied on a tangible medium (e.g., video clips, downloads, online courses, and digital memberships) if we have begun performance of the contract after you:

  1. have expressly agreed that we begin performance of the contract before the expiry of the withdrawal period, and
  2. have confirmed your knowledge that by giving your consent you lose your right of withdrawal upon commencement of performance.

Exceptions to the Right of Withdrawal

According to § 312g (2) BGB, the right of withdrawal does not apply, among other things, to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.
